As one would expect, the loss of the job caused the father, the family breadwinner, to feel depressed and stressed. The father suffered from lumbar and cervical spine pain, requiring microdiscetomy surgery. The father was able to settle with the liability carrier (the defendant driver’s auto policy) for $50,000 and the underinsured motorist carrier (father’s own auto policy) for an additional $50,000, resulting in a total settlement of $100,000. The father was also able to recover $10,000 for medical expense payments under his own policy. This case underscores the need to carry medical expense and uninsured/underinsured coverage on your own automobile policy, and to make sure the limits are high enough to cover medical bills to treat serious injuries.
