Custody Case
N/AOUTCOME: Mother wins
Mother, who lives in Texas with the minor child, had contacted me because Father was able to get a court order from Arizona, granting Father full custody rights of the child. The situation became wors ... e when Father went to Texas and forcibly removed the child from Mother's home. Mother contacted me scared, confused and worried about the child. After I looked into her case, I discovered that Father had lied about certain important facts which caused the court to make an order when they did not have the authority to do so. Luckily, Mother contacted me in time to bring to light the mistruths presented to the court by Father, resulting in the minor child being returned to Mother in Texas. The lesson learned in this case is, when there is a legal proceeding, and you are a party to the proceeding, do not ignore it or rely on the judge to do the right thing. Judges can only make decisions based on the information presented. In this case Mother should have contacted an attorney as soon as she knew of any legal action, which would have prevented the child from being removed from the beginning.
