Winter v. State Farm
N/AOUTCOME: Supreme Court overturned decision by lower court, and held that State Farm must honor its contract and pay benefits.
Insured was injured working on his truck. He had both medical payments coverage through State Farm, and health insurance. Even though the State Farm policy did not have an exclusion for bills paid by ... health insurance, State Farm denied the claim, arguing that the bills were never "incurred" if they were paid by another source. Suit was necessary because State Farm refused to pay what it owed.
