My client was receiving workers' compensation benefits and unemployment benefits concurrently. The Ohio Department of Job and Family Services Administrative Section erroneously and contrary to the Ohi ... o Revised Code, issued a decision that my client was not eligible for unemployment benefits and thus had been overpaid in excess of $25,000.00. We appealed to the Franklin County Court of Common Pleas and the court affirmed the administrative decision. We then appealed to the 10th District Court of Appeals who, in a 3-0 decision, reversed the court of common pleas and found that our client was entitled to unemployment benefits while receiving unemployment benefits and that there was no overpayment.
