Seven Hills v. McKernan (2019-Ohio-1001)
Mar 21, 2019OUTCOME: Client acquitted.
Appellant McKernan appealed her criminal convictions for "prevention of hunting by creating noise" and "possession of criminal tools." McKernan contended that there was insufficient evidence to support ... her convictions and that the trial court erred in denying her motion to dismiss the charges because the statute is unconstitutional on its face and as applied. The appellate court agreed and reversed the trial court’s judgment and vacated McKernan’s convictions.
