N/AOUTCOME: Homeowner and other two defendants were held liable for injuries to the Plaintiff
Case Scenario: Client (Plaintiff) was a guest at a house party. During the course of the evening, he became extremely intoxicated. He got into a shoving match with two other guests who were also into ... xicated. The homeowner intervened and, despite the fact that all three were drunk, told them to “take it outside”, shoving the client out the door. The other two guests then beat him so badly he was in the hospital for nine days. A lawsuit was filed against the homeowner for negligence and against the two guests for assault/battery. After a three-day trial, the jury found against all three and made a 6-figure award. A property owner is not automatically responsible for the actions of a drunk guest. However, once the homeowner intervened, she had a responsibility to avoid putting my client in a more dangerous circumstance.
