OUTCOME: Victory for mom - we kept the children with their mother.

I work in family law, and even though these cases are public, I don't believe it's right for me to disclose my client's names. That said, I recently worked on a custody matter supporting Mom where ... dad attempted to gain full custody of both their children citing that Mom's home was unsafe. Mom's new husband had psychological issues, and was recently arrested for domestic assault, but was no longer in the home.

OUTCOME: The matter which had been in fierce contention for over a year was settled in 5 days.

A young woman came to me, displeased with her attorney of the past year. She was embroiled in a bitter fight with the father of her children regarding parenting time. She wanted to have her children ... as much as humanly possible, which is understandable. She had no concerns about the father's ability or willingness to parent, she just wanted to have her children. However, Minnesota has a presumption that a fit parent will have access to their child 25% of the time, and the opposing counsel was fighting to get my client to agree to that level of time. My client's previous attorney never told her this.
