Ferguson v. Ferguson ~ 2018 ND 122
Jan 01, 2018OUTCOME: Affirmed
The district court properly increased a father's child support because the court retained jurisdiction to modify his child support obligation under the Uniform Interstate Family Support Act because, at ... the time the mother filed her child support motion, the father resided either outside of the United States or in North Dakota—both of which would allow the court to modify its previously entered child support order under N.D.C.C. §§ 14-12.2-45(6) or 14-12.2-08(1)(a), respectively, and the court did not err in imputing to him an amount for in-kind income of his military housing in South Korea under N.D. Admin. Code § 75-02-04.1-01(5).
