The assailant was sent back to his country by the home's owners, who then claimed that it was him acting alone. Jamie was raped by co-workers of Halliburton/KBR on her fourth day in the Green Zone in Baghdad, Iraq. After reporting this to her HR personnel, she was locked in a trailer and armed guards were place...d outside. She was able to get a phone call to her father, who then called his congressman who, in turn, got Jamie released back to the U.S.
Halliburton sought to force Jamie into binding arbitration, relying upon a provision in her lengthy employment contract.
After a favorable ruling on Jamie's behalf, Halliburton appealed that decision to the 5th Federal Circuit Court of Appeals. That appeal resulted in a ruling on Jamie's behalf on September 15, 2009. The court ruled that arbitration was not appropriate for the rape and false imprisonment under these facts. That decision was appealed to the United States Supreme Court, but Halliburton/KBR withdrew their appeal when the president signed the Franken Amendment to the 2010 Defense Appropriations Bill into law. That amendment (created for Jamie Jones) prevents the government from doing business with contractors who force victims of sex crimes and sexual harassment into arbitration. This is a huge first step in undermining the modern-day Star Chambers called arbitration.
Jamie's courage has empowered Congress to enact laws regarding reporting of crimes by military contractors overseas, and has been used to highlight the need for Fairness in Arbitration. H.R. 3010 was proposed to end these abuses.
