Jacobsen v. Jacobsen, 2011 UT App 161
N/AOUTCOME: Appeal affirmed trial court's decision.
Petitioner Veronica Lee Jacobsen (Wife) appeals several aspects of the trial court's order and decree of divorce. Wife argues, among other things, that the trial court erred in determining that the par ... ties' postmarital agreement was valid and enforceable. We affirm. We conclude that the trial court correctly enforced the parties' Agreement, given that they reached a meeting of the minds on the terms therein and that there were no conditions precedent. The trial court correctly determined that Husband was entitled to a credit for the amount of his own separate funds that he used to retire the mortgage. We also conclude that Wife did not preserve her argument that the trial court erred when it awarded Husband interest on the escrow account. The clear weight of the evidence supports the trial court's finding that the parties separated their finances in the spring of 2001. There was sufficient evidence supporting, and we thus affirm, the trial court's decision to use 2000 property values on the household items and the vehicle. Finally, we deny Wife's request for additional attorney fees at the trial court level and deny her request for attorney fees on appeal.
