Client was involved an a vehicle accident with an at-fault-driver who only had the state minimum required insurance coverage. Settlement was achieved with the at-fault-drivers insurance company for th ... e full policy limits. However, this amount did not fully compensate the client for his injuries and a demand was made to the client's insurance company to pay the remaining difference from his Underinsured Motorist (UIM) coverage the client had contracted and paid for. The clients insurance company denied the UIM claim and a lawsuit was filed for breach of contract by the insurance company. The case was litigated by arbitration where after a hearing an arbitrator returned a decision in favor of the client for the full UIM policy limits.
