Loveless vs. Jones

OUTCOME: My client, Jones, prevailed; suit was dismissed.

Elderly Mother, Loveless, sued her daughter, Jones (my client), over the addition of daughter to mother's deed 5 years ago. Mother had no memory of signing the deed but acknowledged that the signature ... is hers. Son of Loveless and brother to Jones instigated a lawsuit when he discovered the deed; he arranged for an attorney to come to the home of Mother and Mother never visited the attorney's office. After bench trial, the lawsuit was dismissed in favor of Client Jones.

OUTCOME: Reversed and vacated all orders of trial court, including $2.7 Million judgment.

Trial Court denied jury trial in major trust dispute with Key Bank who was the outgoing trustee. After 3-day bench trial, the trial Court awarded more than $2.7 Million to Key Bank. Case was appealed ... to the Utah Supreme Court.

OUTCOME: Reversed trial court and set standard for "substantial change in circumstances."

Trial court denied petition to modify alimony based on opposing spouse's receipt of Social Security income that was not anticipated in the decree of divorce. Appealed to the Utah Court of Appeals.

OUTCOME: Reversed trial court and ordered "mother" returned to daughter's home immediately.

Adult Protective Services ("APS") unlawfully removed client's mother from client's home and placed mother in a care facility. Daughter sued APS. Trial Court ruled in favor of APS. Appealed to the Ut ... ah Supreme Court.
