Representation of elderly gentleman in capacity as ward. He began experiencing early stages of memory loss and diminished mental capacity. Opportunistic people began taking advantage of him and charg ... ing him outrageous prices for services. He also began buying things he didn't need and never used, wasting his hard earned money. Guardianship and Conservatorship proceeding was initiated to protect him against future schemers taking his money.

OUTCOME: Swift settlement relieving trustee of the need for a retroactive accounting

Representation of trustee in complex trust administration involving bypass trust, QTIP trust, marital trust, and separate trust with multiple commercial property interests, real property, advancements, ... varied investments, and numerous beneficiaries (including charities). Surviving spouse used a large portion of the QTIP and bypass trust assets and sustained many losses. Beneficiaries claimed that surviving spouse was improperly transferring trust assets between trusts and demanded retroactive accounting dating back nearly 20 years.
