Successfully represented the parents of a 15-year old boy killed by a gun loaded with blank cartridges and used in a school musical, the use of which was sanctioned and encouraged by school officials. ... The case was removed to federal court where the school district claimed governmental immunity, which raised a novel question of state law. Accordingly, the question was submitted to the Utah Supreme Court for decision. The court sided with the Thayer's in determining that the conduct of school district officials in allowing a gun to be present on school grounds was not subject to governmental immunity.
