Rhodes v. UDOT
N/AOUTCOME: The Court of Appeal reversed saying the description was adequate and sent it back to trial court.
Rhodes purchased modular home from UDOT surplus property. UDOT later wanted to buy it back but Rhodes instead offered to purchase the land on which the house sat. Terms were agreed, but UDOT did not fi ... ll out a written contract. Tenants moved in and over a year later UDOT called to say they changed their mind. Rhodes filed suit saying that UDOT could not rely on their own failure to prepare the contract to justify reneging on the deal. On Motion, case was dismissed by trial court for failure to have a written contract, in particular, adequate description of the property.
