A bus collided into the back of a construction truck which killed the bus driver on impact. The construction truck's owners claimed the bus driver should have seen the construction truck and stopped i ... n time to avoid it. Through significant hard work, attorney Brett C. Anderson was able to find many possible violations of the law by the construction truck's owners, including inadequate training, and faulty equipment, which he argued led to the accident and death of his clients' husband and father. The construction truck's insurer initially denied liability and refused to pay anything to the bus driver's family. After Mr. Anderson's hard work in the case, he was able to convince the construction truck's insurer to settle out of court for $900,000.00 to pay for funeral costs of the bus driver and to compensate the family who lost their husband and father.

OUTCOME: Case settled out of court for $903,000.00

Attorney Brett C. Anderson's client was driving on a two lane rural road when he claims he saw a small truck approaching in his lane. The client claimed that at the last moment, he swerved into the on ... coming lane to try and avoid a head-on collision. Instead, the client claims that the small truck also changed lanes back into his own lane and the two vehicles collided head-on at a very high rate of speed. The driver of the small truck was killed at the scene, and Mr. Anderson's client sustained broken bones, including a broken leg, as well as a concussion and muscle strain. The small truck's insurance company initially denied liability since the head-on accident occurred in their insured's lane. In fact the small truck's driver's family made a claim against Mr. Anderson's client's insurance company for the alleged wrongful death of their family member. Notwithstanding, Mr. Anderson believed his client and found evidence to support his claims as to how the accident occurred. Mr. Anderson was then able to convince the insurer of the small truck to pay his client over $900,000.00.

OUTCOME: Case and charges dismissed in favor of Mr. Anderson's client

Mr. Anderson's Client was accused of assault during a high school football game. Police requested and received video recordings of game from the public, and refused or failed to provide them to the de ... fendant's attorney, Mr. Anderson. After a lengthy hearing on the matter, the District Court ordered the City to provide the videos to Mr. Anderson. The videos were not provided as ordered by the Court, and Mr. Anderson convinced the Court to dismiss the charges and the case against his client. The City appealed the case to the Utah Court of Appeals. Mr. Anderson drafted and filed briefs with the Court of Appeals on his client's behalf, and argued the case before the Court where he convinced the judges of the Utah Court of Appeals to affirm the District Court's decision to dismiss the City's charges and case against Mr. Anderson's client.

State Farm Fire and Casualty Company v. Forced Aire, LC, dba Nebeker Heating & A/C; et al.

OUTCOME: Case Settled for in excess of $200,000 after Court of Appeals ruled for State Farm who was represented by Attorney Brett C. Anderson

State Farm paid to have the home of its insured rebuilt, and refurnished due to damages caused by a fire which was believed to have been caused by a negligently installed pellet stove in the home. The ... trial Court initially dismissed the case against State Farm on Defendant's Summary Judgment Motion, claiming that State Farm did not present disputable evidence that a trier of fact could conclude in State Farm's favor. The Utah Court of Appeals disagreed, and reversed and remanded the trial court's decision, ruling that State Farm had met its burden that there was a genuine issue of material fact for the trier of fact to determine at trial. The Defendant's insurer then agreed to settle with Mr. Anderson and his client and paid in excess of $200,000.
