Motor vehicle stop and subsequent search yields marijuana and paraphernalia. Initial motor vehicle stop was improper and charges were dismissed as results of search were fruits of the poisonous tree.

Matter was handled when I worked at the Prosecutor's Office. Defendant was convicted of four burglaries over 27 days. He applied for expungement attempting to claim that the offenses constitute a s ... pree and thus were allowed to be expunged. He was denied expungement in the trial court. On appeal, the appellate panel agreed and denied the appeal and denied the expungement.
OUTCOME: Case Dismissed after trial
Final Restraining Order hearing. Court dismissed TRO after a trial.
