OUTCOME: Dismissal

The defendant was visiting a friend's house. The friend was on probation and while the defendant was there, officers arrived to search the home. The officers found multiple places where marijuana o ... r marijuana residue was located as well as several items of paraphernalia. None of these items were located on the defendant. The officers arrested everyone in the apartment for possession of a controlled substance and paraphernalia. While searching the defendant incident to arrest the officers discovered prescription medication for which the defendant lacked a prescription. The defendant was charged with misdemeanor counts of possession of a controlled substance and paraphernalia and a felony count of possession of a controlled substance. We filed a motion to suppress on the felony count, alleging the search incident to arrest was unlawful as the officers lacked probable cause to arrest the defendant. We prevailed and the evidence was suppressed. As a result of the suppression, the State dismissed all counts against the defendant. The defendant is now considering filing a 1983 action against the arresting officers.

OUTCOME: Acquittal

The defendant was accused of stealing money from a security office safe. The defendant was the last known person to have handled the money but asserted he had secured the money prior to going home from ... his shift. Several guards knew about the money and had the opportunity to take it, including one who had previously brought a lock picking set to work and had successfully picked the safe lock for a coworker. Despite this, the police charged our client. The matter was taken to a jury trial where the jury returned a verdict of acquittal.

OUTCOME: Dismissal by Directed Verdict

This was a modification case. The petitioner was seeking additional visitation time and less child support. The matter went to trial. Through the petitioner's case-in-chief, we relied solely on the pet ... itioner's own evidence. At the conclusion of the petitioner's case-in-chief, we moved for a directed verdict and won the matter without having to put on any of our own evidence. We then asked for our attorney's fees and costs and were awarded those as the petitioner's case was deemed frivolous. The petitioner filed bankruptcy and tried to have the award of attorney's fees and costs discharged. We fought the discharge as not including attorney's fees awards arising from family law cases and prevailed. The petitioner has since paid the entire amount awarded.

OUTCOME: Dismissed

This case involved a man who flipped off a police officer while driving past. The officer followed the man to his home where he engaged in a verbal confrontation with the man. The officer then walked a ... round the man's car to find any and all infractions he could to punish him and arrested the man for obstruction of justice. We filed a motion to dismiss, arguing that the officer lacked a reasonable suspicion to stop the defendant. We prevailed on the motion to dismiss. Later we filed a 1983 lawsuit against the officer. The matter was resolved with a non-disclosure agreement.

Two defendants were accused of several counts of felony aggravated assault and felony aggravated battery for allegedly following a man home and attacking him in his driveway. The man's parents came out ... to assist and were also allegedly accosted by the defendants. This case went to a jury trial and the defendants were acquitted on all charges.
