OUTCOME: Client plead to unlawful possession of marijuana which is a violation and not a crime. Thus, the client's license was not suspended.

Client is charged with Criminal possession of marijuana (5th degree), aggravated unlicensed operation of a motor vehicle, among other traffic infractions. I am currently working with the prosecutor to ... negotiate a non-criminal disposition, that would not result in the suspension of his license by the DMV. The client expressed great concern about his license being suspended as a result of pleading to or being convicted of a criminal possession of marijuana charge, so I am working diligently to avoid the suspension if at all possible.

The People failed to attach the underlying court order to the accusatory instrument or allege that ... my client was made aware of the court order. An omnibus motion was filed requesting dismissal due to facial insufficiency, and the judge granted the motion and dismissed the charges.

Client was charged with resisting arrest, obstructing governmental administration, and harassment for allegedly striking a police officer in the face and subsequently resisting arrest. An omnibus motio ... n was filed requesting dismissal for facial insufficiency on the ground that it was not alleged that my client struck the office with the intent to annoy, harm or harass as required by statute. An argument was also made that my client's behavior did not obstruct the police officer from performing any official police function. Additionally, absent a sufficient basis for charging obstructing governmental administration and harassment, the resisting arrest charge must be dismissed. The judge dismissed all charges in his decision.
