OUTCOME: Unfavorable--Oklahoma Supreme Court reversed trial court and entered summary judgment for OMAG
This one hurt. The trial court awarded about $2,000,000 which the Oklahoma Supreme Court reversed.
Oklahoma Municipal Assurance Group (OMAG) accepted defense of city and defended suit against city ...for nearly two years, knowing the claim against its insured was for inverse condemnation, only to withdraw and disclaim coverage about a month before trial, only then asserting a policy exclusion for inverse condemnation. The city lost at trial and we were brought in to sue for coverage under the OMAG policy.
Though OMAG both admitted in discovery that it was an "insurance company," and was so by a statute making it an insurance company based upon annual premium revenue earned, the Oklahoma Supreme Court held that it was not an insurance company "for all purposes," and was not estopped to withdraw the defense and coverage on the eve of trial.
