The Petitioner and Beneficiary are high school sweethearts. The Beneficiary arrived to the United States as a visitor from Estonia on a visa waiver (ESTA) and remained in the USA beyond the 90 day auth ... orized stay. Two years after graduating high school, in 2013, the couple married and applied for Adjustment of Status pro se. The case was adjudicated by USCIS and a Notice of Intent to Deny (NOID) was issued based on inconsistencies and lack of marriage bona fides. The couple arrived at my office requesting assistance. We helped them file a supplementary package of documents but USCIS still denied the application. My office advised them to re-file with our assistance. The case was re-adjudicated by USCIS and remained pending for over 9 months after the interview. Our office advised USCIS that a writ of mandamus would be filed with the Federal District Court if no decision was to be rendered within 30 days. The application was adjudicated and the Beneficiary was adjusted to permanent residence.
