There is an automatic stay in the event of a bankruptcy but that be set aside. I wouldn't convert to a dissolution though. Get what you're entitled...

Probably not but to be safe, have your attorney argue a de facto termination of the marriage back to the date you separated.

The reality is you probably don't. If no counterclaim had been filed, you could dismiss and refile in your new county. I agree with your attorney.
