Three days later, mom underwent a second surgery due to a retained sponge. Following a 5-day trial, the jury awarded the the brain damaged child $3,000,000 (reduced to $1,250,000 under the Indiana Medical Malpractice Act cap) and mother $200,000 related to the C-section. The jury also awarded the mother $500,000 on the retained sponge.
