Snider v. Stowell
Feb 26, 2009OUTCOME: Excess verdict of $760,000
I was lead counsel on this case. I personally handled all of the trial preparation and nearly all of the trial . My co-council handled the defendant who had admitted liability prior to trial. He also ... handled the closing argument rebuttal. An offer of less than the $100,000 policy limit was declined. A vehicle made a turn into the path of the plaintiff's oncoming motorcycle. The defendant claimed that while the plaintiff did suffer a disk herniation, that it was not related to the collision. The defendant's expert claimed the plaintiff had herniated her disk while sleeping. Under my cross-examination, the defendant's expert admitted that he had failed to note in his report that the 700 pound motorcycle had fallen on the plaintiff. He had to concede that he had three medical records in his file that described the motorcycle falling on the client. The plaintiff had approximately $24,000 in past medical bills and $135,00 in probable future medical bills for a spinal fusion.
