Forclosure Assistance

My Sister's business and personal estate lawsuit & foreclosure

Initially needed legal advise regarding my sister's ownership of a rental apartment and commercial property, an LLC corporation. About one year ago, one apartment renter filed lawsuit alleging accidental death as a result of slip and fall claim. My sister attended all scheduled court dates, whereas... plaintiff's attorney did not attend any. According to Ohio State law, my sister should have retained a lawyer to represent her, which she choose to not retain a legal representative. Judge after three (3) scheduled court appearance without her lawyer, the Judge issued a summary judgment in the amount of $500K, just because she did not retain legal representation. With Mr. Herman's guidance and appropriate legal advise, we choose to challenge the Judge's summary judgment. Mr. Herman won upon appeal that resulted in an over-turning the Judge's decision. Plaintiff subsequently dropped further legal action. Unfortunately shortly after the Judge's summary judgment, my sister passed away from an initial brain aneurysm, then several years later was affected with cancer, that she fought through over her last six (6) years. This also adversely effected her business. Many months after the slip and fall claim, an additional suit was filed against her personal loan that was guaranteed by her rental apartment and commercial property. This suit is currently in process of being foreclosed. Early in the legal process, my sister also requested my opinion and guidance on these matters. Mr. Herman has professionally administered both suits to my complete satisfaction, even in spite of the fact of the loss of her rental property assets. Ed's resolution of the $500K trip and fall suit to my sisters benefit was unexpected; yet, she would have been very pleased since she truly believed her business was not at fault for the slip and fall claim. Throughout all of the above, I sincerely appreciate Ed's efforts on my sister's behalf. He is very articulate individual, he needed to dumb down the legal issues for my sister and my behalf (made the legal issues and procedures more easily understandable so that we could make informed decisions), and Ed's invoices were fair, reasonable, and truly reflected his efforts! He earned my sister's, as well as mine, trust and faith in his guidance and legal recommendations. Above all, I sincerely respect and thank Ed for his compassion and empathy while my sister struggled through her health conditions. The best complement is that I would seek his legal guidance if I was in need of a lawyer.

I'm currently serving in the U.S. Army on active duty. When I left Cleveland for a new assignment, I was not able to sell my house. The bank rejected my application for deed-in-lieu of foreclosure. After the bank began a foreclosure lawsuit, Ed was appointed as my military attorney. Ed got it... done for me: the deed-in-lieu was accepted and the foreclosure case against me has been dismissed.
