Lassiter v. Lassiter
Jun 04, 2014OUTCOME: Defendant's award for attorney fees vacated.
Appeal from award of attorney fees to defendant, where the court sanctioned the creditor Plaintiff for attempting to timely revive and collect a dormant judgment from the debtor defendant, because the ... court believed the creditor had malicious intent in doing so. The Court of Appeals determined that it could not "say that it is sanctionable conduct to attempt to collect a valid judgment in a legally permissible manner, no matter what our guess may be as to the debt collector’s subjective motivation."
