False Arrest at Chili's Dismissed

OUTCOME: Case dismissed because we proved the police violated his rights.

My client was walking out of Chili's restaurant. The police stopped him and falsely accused him of having a warrant for his arrest. They claimed he ran from them and fell to the ground, causing multi ... ple injuries. They charged him with resisting arrest. We moved to suppress the stop because it was a violation of his constitutional rights. The police had no good faith basis to stop him. He did not have a warrant.

OUTCOME: Not Guilty All Counts

My client was charged with a operating a vehicle while intoxicated. There were witnesses that said they saw him driving. To make matters more difficult, the police said he confessed to drinking and ... driving. My client wanted to fight these false allegations. The prosecutors would not dismiss the case so we went to trial by jury. The first trial ended in a mistrial when the prosecutor lost his temper and called me names during the trial and in front of the jurors. His courtroom outburst catapulted the case to the local and national news. Also, the prosecutor was suspended and taken off the case. Round two was not much better for the State of Indiana. The jury returned a verdict of not guilty on all counts
