OUTCOME: Trial Court Reversed

In Coffman v. Coffman, Mr. Hutson served as co-counsel on appeal for a husband appealing a trial court's distribution of a marital estate. The trial court held that several debts should be excluded fr ... om the marital estate and awarded the wife an "equalization" judgment in excess of $200,000. Mr. Hutson co-wrote a brief that argued the trial court erred by excluding the debts and that the trial court erred by awarding the wife a judgment in excess of the value of the marital estate. The Court of Appeals agreed and reversed the trial court's judgment, holding that the trial court could not award the wife a judgment in excess of $17,950, the value of the marital estate.

Imperial Insurance Restoration & Remodeling, Inc. v. Costello, 965 N.E.2d 723 (Ind. Ct. App. 2012)

OUTCOME: Trial Court Reversed

In Imperial, Mr. Hutson appealed a small claims judgment denying home restoration company compensation for services rendered. At trial, the defendant argued that even though the consumer failed to pay ... the restoration company, that the restoration company could not collect the amount owed because the written contract did not include terms required by Indiana's Home Improvement Contracts Act (HICA). Mr. Hutson argued on appeal that the consumer's failure to file a HICA claim precluded it from voiding the contract. The Court of Appeals agreed, and reversed the trial court's judgment. The case settled a matter of first impression in Indiana, and was discussed in Barnes and Thornburg LLP's "Construction Law Update" in June of 2012.

New Albany Historic Preservation Commission v. Bradford Realty, Inc., 965 N.E.2d 79 (Ind. Ct. App. 2012)

OUTCOME: Trial Court Reversed

In NAHPC v. Bradford Realty, Inc., Mr. Hutson served as co-counsel in a case revolving around the City of New Albany's decision to designate downtown New Albany as a historic district. Bradford Realty ... , Inc. argued, among other things, that it was entitled to notice of the City's decision to designate its property as part of the historic district. The trial court granted summary judgment in favor of Bradford Realty, in effect exempting it from the requirements of the City's Historic Preservation Ordinance. Mr. Hutson assisted in arguing to the Indiana Court of Appeals that no such notice was required. The Indiana Court of Appeals reversed the trial court and found that Bradford Realty was required to follow the requirements of the Historic Preservation Ordinance.

OUTCOME: Trial Court Reversed

Mr. Hutson represented a mother who was held in contempt by a trial court for failing to put her child on a flight for a visit with the child's father. Mr. Hutson argued that the parenting time order ... was vague and did not unambiguously command the mother to place the child on the flight. The Court of Appeals agreed and reversed the trial court's finding of contempt.
