Our client was injured in a trip and fall accident at a fast-casual dining chain. Our client claimed she tripped over a bunched-up floor mat in the restaurant and fell forward, suffering a fractured sh ... oulder that required surgery. The restaurant claimed the floor mat was flat and that our client simply tripped over her own feet. We deposed restaurant employees to establish policy and procedure violations and retained a human factors expert to testify regarding the mechanics of the fall. Ultimately, the restaurant settled rather than take the case to trial and risk a more substantial damage award.

We represented the family of an elderly gentleman who was killed when his residential exterior lift failed and dropped to the ground. We worked though numerous liability issues including the fact that ... the lift had several warnings stating that it was for cargo use only, despite the fact that the lift salesman knew our clients intended it for personal use. We recovered a settlement on theories of breach of implied warranty and unfair trade practices.
