I created a photo lineup and asked the hit and run v ... ictim to identify the driver, and he did not select the picture of my client. The government asked the police officer what was found in the vehicle, and the answer was intended to be a whiskey bottle, but the police officer instead volunteered that an empty gun holster was found. On the fly, we took advantage of the mistake and brought out that the car was in a bad part of town and my client experienced trauma to the back of the head. Between the misidentification and the inference that my client was actually a victim, the government was unable to prove he was ever in control of the vehicle while he was intoxicated.

My client was previously convicted at court martial of several felony offenses. Upon going into confinement, he tested positive for marijuana. Client's fiance testified that she witnessed cash payments, and the mothers own father witnessed one payment as well. Showed a motive to lie because of bad blood between the families. Mother's brother was with client's cousin when the brother was shot and killed, and she always held client's cousin responsible.

She described ripping and tugging of her clothing, but when her clothing taken into evidence ... was removed there were no rips and tears to reinforce her story. The jury was split 6-6, and rather than try the case again, the state agreed to a non-sex offense misd charge that would get client out of jail immediately.
