On March 20, 2014, Michael Duma conducted a preliminary hearing where his client was charged with burglarizing a residence and stealing items within. Michael’s client was on parole at the time the alle ... ged offenses occurred. Due to the serious nature of the client’s previous offense for which he was on parole, the client would be subjected to a prison term exceeding twenty years if that parole were violated. At preliminary hearing, the State presented the testimony of the client’s co-defendant, who had already pled guilty to burglarizing the residence. The co-defendant testified that she burglarized the residence and that Michael’s client assisted her. After a thorough and challenging cross-examination of that witness, however, the Court found that she was not a credible witness and that her testimony could not be relied upon to bind Michael’s client over for trial. The Court discharged Michael’s client from further liability on all charges against him. As a result, Michael’s client was released from custody in that case and faced no additional prison time as a result of the charges lodged against him.
