OUTCOME: Not Guilty
Our client was charged with two counts of second degree murder. The prosecution alleged that our client and his co-defendant shot and killed two people after a fight at a nightclub. The co-defendant we ... nt to trial and was found guilty on both counts. During our client's trial Kevin successfully argued that the methods used by the police to identify our client were faulty and the eyewitness identification by the witnesses was unreliable and tainted by the police's faulty procedure. Our client was found not guilty on both counts.
OUTCOME: Not Guilty
Our client was indicted for bankruptcy fraud in connection with the filing of numerous personal and business bankruptcies. The FBI conducted a search and seizure of a safe deposit box and located a lar ... ge amount of cash. The cash was not listed as an asset in the pleadings filed with the bankruptcy court. During our investigation, we uncovered bank records which allowed us to argue that at the time of the filing of the bankruptcies, our client had forgotten about the money in the safe deposit boxes. Seven members of the twelve person jury voted not guilty which caused a mistrial. The case was successfully concluded when the government offered for our client to plead guilty to a misdemeanor charge.
OUTCOME: Not Guilty
Our client was charged with illegally intercepting satellite signals. The government claimed that our client was using software to re-program DirecTV program cards to illegally intercept DirecTV's sate ... llite signal and obtain DirecTV programming without paying for it. The FBI raided his office and located the equipment and software used to re-program cards in his desk. During our investigation, we learned that his business partner was seen prior to the search walking around the office with the re-programming equipment. Kevin argued to the jury that the clients business partner planted the illegal devices so she could steal the business. The jury found our client not guilty on all counts.
OUTCOME: Not Guilty
Our client was charged with 35 counts of sexual assault and 30 counts of physical abuse. At the close of the prosecution's case, the Court dismissed all physical abuse charges. The remaining sexual ass ... ault counts were submitted to the jury. The jury returned a verdict of not guilty on all counts. Kevin was the first attorney in the country to get the Abel Assessment for Sexual Interest, a testing device which detects pedophiles, admitted into court. He used the test results of his client to convince the jury that his client had not committed the horrible acts of abuse claimed by his step daughter.
