Succession of Maude E. Edwards
Feb 05, 2018OUTCOME: Judgment overturning previously probated Last Will and Testament
Sibling probated an alleged Last Will and Testament of mother and had herself appointed as executrix of the estate. Using her power as executrix, she then filed eviction proceedings against family to ... eject them from property they had lived on for many years. Brad and his probate team successfully blocked the eviction action, and then successfully challenged and obtained judgment invalidating the Last Will and Testament probated by the sibling. Brad and his probate team made the legal argument that the Last Will and Testament was not valid because the decedent was legally blind at the time it was allegedly signed. The Last Will and Testament did not have the statutorily required language to prove that the will was read to the decedent and that she knew what she was signing.
