This was an appeal from the decision of the Court of Common Pleas of Delaware County and a case of first impression under the PA mechanics' lien law. The Superior Court agreed with my argument (and ma ... de new law) that it is permissible for a claimant to plead in the alternative, i.e., as both, a contractor and a subcontractor. This was a published opinion. Client was very happy.
