Thereafter, we filed a subrogation suit against the insurance broker for one of our insured's subcontractor's based on an erroneously issued certificate of insurance because the insurance broker provided a certificate of insurance for a policy that did not exist. We were able to recoup almost all of the funds paid out on the original settlement to Dr. Faust in the subrogation suit against the subcontractor, its broker and the various insurance companies involved based on the erroneously issued certificate of insurance.
