OUTCOME: The Court decided in favor of the former spouse but on the facts that there was not a ten year period where she did not "use" the usufruct . . . but it also held a lifetime usufruct could prescribe after 10 years non-use.

The La Supreme Court decided whether a "lifetime usufruct" to a former spouse could terminate by non-use of ten years.
