At a probable cause hearing, the court determined that no probable cause existed to justify issuing a felony arrest warrant for a client of Kelly Law. The alleged victim testified on direct that the a ... ccused was fraudulently paying herself from the "victim's" bank account. On cross-examination by Mr. Kelly, however, the accuser eventually admitted to the authenticity of messenger messages between the two wherein the accuser admitted to having prior knowledge (without objection) that the Defendant was earning the paychecks she had written. It seemed that the complaining party's chief complaint was the timing of the pay-checks, not the fact that they had been written. The court ruled that while such might be a legitimate civil dispute, it was not evidence of fraud.
