On No ... vember 10, 2011, Todd Stein was completing work at Melinda Knight’s residence when he was tripped by her unrestrained dog, causing him to fall down her stairs. Mr. Stein had made repeated requests for Ms. Knight to control her dog. The Defendant denied that the accident happened, that she was at fault, and that Mr. Stein was injured. During deliberations, the jury had 1 question - what is the maximum we can award the Plaintiff. After the question was submitted, the parties settled the case for State Farm's policy limits of $100,000.00. As the parties reached settlement, the jury knocked and was ready to deliver the above verdict. Injuries: Lumbar and neck sprain, as well as knee pain. Plaintiff's worker's compensation IME doctor, Warren Bilkey, assigned an 8% whole person impairment for the lumbar sprain and a 2% whole person impairment rating for chronic knee pain, for a total whole person impairment rating of 10%. Damages: Medical expenses of $23,087.13, with $1,957.10 allowed by Phoenix Insurance Company, the employer's worker's compensation carrier. $10,846.76 in lost wages.
