Plaintiffs also claimed that the school district was also liable pursuant to 42 U.S.C §1983 and the Fourth Amendment to the United States Constitution, to the extent it supported and permited automatic and overly invasive searches of cell phones confiscated on school grounds and for failing to give parents and students notice of any such policy prior to the confiscation of cell phones.
