Telebrands has agreed to settle a class action lawsuit stemming over allegations that the company made false promises when advertising its Aero Knife. Plaintiff filed the Aero Knife class action law ... suit on behalf of herself and all other Missouri residents who purchased the “As Seen On TV” knife. Telebrands was accused of engaging in practices that “constitute deception, fraud, false pretense, false promise, misrepresentation, unfair practice or the concealment, suppression or commission of material facts in connection with the sale and/or advertisement of the Aero Knife.” Under the terms of the class action settlement, Telebrands is offering Missouri residents who purchased the Aero Knife a full refund if they return the product to the Claims Administrator. Missouri residents who bought an Aero Knife but do not return the product are still eligible for a $5 cash award. In addition to offering a full refund to consumers who return the Aero Knife, Telebrands has also agreed to stop promoting the product as a “$50 knife for $10.” Rehak will receive an incentive award for bringing the class action lawsuit in the amount of $10,000 and Class Counsel is expected to receive $200,000 to cover legal expenses. The Aero Knife class action settlement was preliminarily approved on March 8, 2017. The deadline to opt out of the terms of the settlement or object passed on June 6, 2017.
