OUTCOME: The court of appeals upheld the trial court's ruling that the faculty member challenging the University would not be reinstated.

Representing Ohio Wesleyan University, counsel was successful in having the University’s decision to not reappoint a pre-tenure faculty member upheld. The professor filed a petition for preliminary inj ... unction along with her breach of contract claim, seeking reinstatement to her faculty position. The matter was tried to the trial court on both the preliminary injunction and the merits. Key issues on appeal were whether the University’s faculty handbook created a contractual relationship between the professor and the university, whether the University properly followed its review and internal process, and whether the faculty member’s collegiality or lack thereof had properly been considered in the University’s decision.

OUTCOME: The Ohio Supreme Court agreed with the Township's position as to the rights of owners.

The Ohio Supreme Court accepted a discretionary appeal on the issue of whether fee owners of property that lies in a road right-of-way are “owners” for purposes of Ohio’s annexation law, Chapter 709. ... Representing a Township Board of Trustees, we argued that such property owners did meet the statutory definition of owner and, thus, had to be included in determining the number of owners needed to sign an annexation petition.
