James Francis Flynn

Jim Flynn is a partner in and chair of Bricker & Eckler's Health Care group. His general health care practice focuses on transactional, reimbursement-related, health planning and long-term care matters, including experience in physician contracting, joint ventures, federal and state regulatory issues, fraud and abuse, False Claims Act, certificate of need, community health needs assessments, corporate compliance, corporate organization and governance, Medicare and Medicaid reimbursement, and federal and state administrative appeals. In these areas, he has appeared before federal and state courts, the Provider Reimbursement Review Board, Administrative Law Judges, state agency administrative hearings, and in medical staff hearings.

Jim represented a hospital in Riverside Methodist Hospitals v. Tommy Thompson (2003 U.S. Dist. LEXIS 15163, 2003), overturning disallowance of residents in IME count based on nature of residency program activities; represented the Ohio Hospital Association in OHA v. Shalala (201 Fed. 3d 418, 1999), successfully challenging the government's use of the False Claims Act in Ohio's laboratory unbundling litigation; and represented a hospital in Rush-Presbyterian-St. Luke's Medical Center v. Shalala (1997 U.S. Dist. LEXIS 13224, 1997), ordering the government to update reasonable compensation equivalent (RCE) limits.
