After injured worker filed action against contractor and subcontractor, contractor filed cross-claims against subcontractor for contractor's expenses in defending and settling worker's action. The Jeff ... erson Circuit Court, No. CV-92-5332, G. William Noble, J., entered summary judgment for subcontractor. Contractor appealed. The Supreme Court, Johnstone, J., 796 So.2d 1076, affirmed in part, reversed in part, and remanded. On remand, the Circuit Court entered summary judgment in favor of contractor. Parties appealed. The Supreme Court, Stuart, J., held that: (1) fact questions precluded summary judgment on contractor's claim for indemnification, and (2) trial court improperly concluded that subcontractor was precluded from contesting its own liability under indemnification agreement.
