LVL, Inc. v. Ragsdale, 2013 Ark. App. 65, 426 S.W.3d 473 Ark.App. 2013
Feb 06, 2013OUTCOME: Lower court affirmed
Substantial evidence supported Workers' Compensation Commission's conclusion that injuries suffered by claimant, a long-haul trucker, when his truck was rear-ended by another truck as he turned off the ... highway into a truck-stop complex to take a restroom break and check tires, occurred while he was performing employment services; location was a place claimant routinely stopped to perform a safety check, claimant was transporting mail as required by his employer when wreck occurred, and, although claimant told state trooper at scene he only intended to purchase cigarettes, reasonable minds could find that the claimant was also stopping to use restroom facilities after driving for two hours of what was to be an 11-hour trip.
