OUTCOME: Overturned

In an action where a grandparent won custody against the natural parents on default judgment, the natural mother appealed on the issues of whether custody could be changed without conducting a hearing ... and on whether a non-possessory non-parent can take custody from a parent on the basis of an affidavit alone. The trial court was overturned and the children were reunited with their mother.
