OUTCOME: Victory, the stop time rule can only be applied prospectively.
Whether the stop time rule may be applied retroactively to crimes before the enactment of IIRRIA.
OUTCOME: In a published opinion, the Board of Immigration Appeals held that domestic violence is not a crime involving moral turpitude.
Alien, lawful permanent resident, charged with two crimes involving moral turpitude not arising out of a single scheme of criminal conduct. Argued to the Immigration Judge that domestic violence, unde ... r the Virginia statute, is not a crime involving moral turpitude. The Immigration Judge disagreed and ordered the longtime permanent resident deported. We appealed. On appeal, the BIA held that the Virginia domestic violence statute does not necessarily involve moral turpitude and terminated removal proceedings and restored the client's green card.
