Ms. Baniowski represented Father in a divorce case, wherein the major issue was custody of the parties' preschool-aged child. Father was a student and active duty military. Mother was a student. Father ... hired Ms. Baniowski, and a two day trial was scheduled in early 2014. The Prince William Circuit Court docket was overwhelmed, and the court was not able to hear the matter in early 2014. The parties had to reschedule their trial date to Fall 2014. However, Father was, due to military orders, scheduled to move to a state that is 7+ hours away from Prince William County at the end of May 2014. Ms. Baniowski filed a Motion for Temporary Relief pending the final trial, requesting that the court grant Father primary custody of the child and permit the child to relocate with Father pending the final disposition. Prior to the hearing on that motion, Father was primarily caring for the child during the week, and Mother was primarily caring for the child on the weekends. At the hearing, Ms. Baniowski was able to demonstrate that it was in the best interests of the child to relocate with Father and remain in his primary care pending the final hearing. Ms. Baniowski was able to make the same demonstration at the final two-day trial, and the child now resides primarily with Father in another state.
