OUTCOME: Custody and Relocation Determination in Favor of Father

Ms. Baniowski represented Father in a divorce case, wherein the major issue was custody of the parties' preschool-aged child. Father was a student and active duty military. Mother was a student. Father ... hired Ms. Baniowski, and a two day trial was scheduled in early 2014. The Prince William Circuit Court docket was overwhelmed, and the court was not able to hear the matter in early 2014. The parties had to reschedule their trial date to Fall 2014. However, Father was, due to military orders, scheduled to move to a state that is 7+ hours away from Prince William County at the end of May 2014. Ms. Baniowski filed a Motion for Temporary Relief pending the final trial, requesting that the court grant Father primary custody of the child and permit the child to relocate with Father pending the final disposition. Prior to the hearing on that motion, Father was primarily caring for the child during the week, and Mother was primarily caring for the child on the weekends. At the hearing, Ms. Baniowski was able to demonstrate that it was in the best interests of the child to relocate with Father and remain in his primary care pending the final hearing. Ms. Baniowski was able to make the same demonstration at the final two-day trial, and the child now resides primarily with Father in another state.

OUTCOME: Custody and Relocation Determination in Favor of Mother

Mother and Father were never married. Parties had two grade-school aged boys, and Mother and Father had been working out the custody and visitation of the children informally, primarily maintaining a 5 ... 0/50 arrangement. The parties jointly planned to relocate to an adjacent state, and Mother was actively seeking employment and housing as a result. Mother secured a job and housing, and upon noting same to Father, Father dissented and filed for custody in Prince William J&DR Court. Prior to filing his petitions, Father was acting as the children's primary caregiver during the work week. Mother's employment required that she travel often and occasionally work on the weekends. Mother hired Ms. Baniowski. Ms. Baniowski filed a motion requesting the court grant temporary custody to Mother and allow the children to relocate with Mother pending the final trial. Mother was scheduled to move to another state just days after the temporary hearing. The purpose of temporary hearings is to, for the most part, maintain the status quo pending the final trial. Nonetheless, Ms. Baniowski was able to demonstrate at the temporary hearing that the children were best placed with Mother, despite the relocation. The court ruled in favor of Mother based upon the stability of Mother's home, the poor choices made by Father, and Mother's willingness to support the children's relationship with Father. Ultimately, Mother's temporary order became the final outcome of the case, and Mother is presently the children's primary custodian.

OUTCOME: Custody Determination in Favor of Mother

Mother and Father were married and had an infant child. Father filed unsupported criminal charges against the Mother, absconded from Virginia with the child, threatened to leave the country with the ch ... ild, and then ceased all contact with Mother. Mother was unable to reach Father and the child, and Father would not reveal his location. Mother hired Ms. Baniowski. With the little information Ms. Baniowski had at her disposal, she was able to conduct an investigation and found Father residing in a state that is 19+ hours away from Prince William County. Ms. Baniowski petitioned the court for custody of the child, filed a motion to enjoin the child to the Commonwealth, and served Father at the determined location. The court granted the motion to enjoin the child to Virginia, granted the Mother temporary custody of the child, and ultimately awarded Mother sole legal and physical custody of the child, with Father being prohibited from having any contact with the child.
