My client was rear-ended by the Defendant as she was waiting to make a left turn. She sustained soft tissue injuries to her back and neck which caused her chronic pain and sleep disruption. The pain ... from her injuries made her unable to engage in the physical activities she had been accustomed to prior to the collision. The Defendant's insurance company admitted liability but refused to fairly compensate my client for her injuries and pain. My client incurred approximately $8,500 in medical bills. The insurance company's final offer before trial was $13,500. At trial, we presented several witnesses who testified about the collision, my client's injuries, and the consequences of her injuries. The defense argued that my client's injuries should have healed in a matter of weeks and that she was exaggerating her symptoms. The judge ruled in favor of my client and, with the inclusion of prejudgment interest, awarded approximately $28,000 to her, more than double the insurance company's final settlement offer.

As a result of the collision, the plaintiff suffered multiple tears in his shoulder which required two surgeries and an extensive course of physical therapy. Plaintiff claimed future medical expenses which the defense strongly contested during negotiations. Settlement negotiations were complicated by a significant worker’s compensation lien and required Medicare Set-Aside. However, the matter was resolved at mediation two months prior to the scheduled trial date.

The plaintiff was diagnosed ultimately with a mild traumatic brain injury as a result of the wreck.

A dump truck rear-ended a single mother on a major road in Virginia Beach. The property damage was extreme. Plaintiff later developed cognitive deficits as a result of the mild TBI, including memory lapses and difficulty concentrating. Her injured spinal connective tissues were treated by a chiropractor. Plaintiff was able to return to work without income loss despite her deficiencies. Defense experts challenged the cause and extent of plaintiff’s continuing symptoms, arguing that most minor concussions heal within a short time after the incident if she even had one. The defense doctors also argued that the plaintiff had only psychological harm (PTSD) from the wreck, not a brain injury. The defense neurologist posited that depression or PTSD, rather than permanent brain damage, presents a more benign prognosis. A settlement was reached at the mediation – two months prior to trial in Virginia Beach. The strength of the claimant’s presentation as well as strong before and after witnesses added value. Further, the commercial driver had a long felony record practically preventing him from testifying.
