OUTCOME: Visitation Preserved for Father

Mother filed a motion for supervised visitation alleging the Father sexually assaulted the minor child. Ms. Connolly represented the Father on this motion and successfully cross-examined the Mother’s m ... edical professionals who admitted on the stand that the complaints the Mother brought forth did not prove sexual abuse. Ms. Connolly also presented evidence from the department of social services that found no evidence of abuse. After hearing the Mother’s entire case, Ms. Connolly moved the court to strike the Mother’s evidence and the Court granted that motion. Father’s visitation resumed as previously ordered by the court.

OUTCOME: Custody Returned to Mother on Appeal

Ms. Connolly represented a Mother first in Juvenile Court on the Mother’s motions to modify an existing visitation order on her three minor children. The Father filed his own motions to modify custody ... in response to the Mother’s motions. After a three hour trial, despite the evidence showing the Mother being an involved Mother and the GAL’s recommendation that the children remain with the Mother, the Juvenile Court granted custody to the Father. Ms. Connolly appealed to the circuit court on behalf of the Mother. During the pendency of the appeal, the children resided with the Father for approximately eight months. At the appeal hearing, Ms. Connolly again presented the evidence of the Mother being an involved parent, including attending school functions, volunteering in classrooms, volunteering to coach different sport activities and continuing to do all of these things while the children resided with the Father during the pendency. Witnesses were put forward the corroborated the Mother’s involvement with the children. After a full day appeal hearing, the Circuit Court awarded custody back to the Mother and visitation to the Father.
