Protecting the Family Farm
N/AOUTCOME: We successfully qualified for Medicaid and didn't have to sell (or even offer to sell) any land.
We represented a husband and wife when the husband had early onset dementia and needed to qualify for Medicaid to pay for the cost of him being in nursing home. They owned over 20 acres of prime land ... that had been in the family for generations and wanted to ensure that the land did not have to be sold for the husband to qualify for Medicaid. They also owned cash accounts, cars, and retirement accounts. After multiple conversations reviewing the details of their assets, family dynamics, and ultimate goals, we used our knowledge of the Medicaid rules to come up with a plan to preserve not just the land, but the other assets too. We then worked together to execute the plan in an efficient and timely manner, and received approval for his Medicaid coverage in less than forty-five days.
